Hilka Terms and Conditions

1. Order Quantities

Order quantities, carton and inner sizes are shown throughout. The minimum order quantity must be adhered to when ordered unless specific agreement in writing has been received from an Area Sales Representative or the Sales Office Supervisor. We recommend ordering in the inner or where possible carton quantities to ensure the goods are well packed and protected in shipping. 

Stock not available at time of processing will be dealt with as per customers instructions. If held on backorder they will normally be delivered if available with the customer’s next order unless they reach the minimum carriage paid amount, in which case they will be shipped. Unless instructed back orders will be held for a maximum of 60 days and then cancelled.

2. Carriage

For Wholesale customer free of charge delivery is available on all orders in excess of £150 net value to the mainland or £1,500 net value to Northern Ireland. Other rates may apply.  A charge for orders under this value will be made of £6.00. Any time or date given for delivery is an estimate only and Hilka Tools (UK) Ltd shall not be liable for any delay. In the event of circumstances beyond the control of the company the deliveries may be suspended or cancelled.

3. Carriage Overnight

This can be arranged subject to agreement providing the order is received in the Sales Office by 11.00am and is subject to the following charges:
Under Carriage Paid:       £12.00 per order
Over Carriage Paid:       £2.00 per carton or £20.00 per pallet.
For Northern Ireland and Northern Scotland prices upon application.

4. Direct Dispatch 

It is the seller’s responsibility to ensure all order quantities, contact & delivery details are correct when sending orders through.

5. Payment Terms

All accounts are strictly net and payments must be received within 28 days from date of invoice, exception by application and written approval only.

6. Prices

The prices within cancels all previous prices and are ruling at date of dispatch. All prices are exclusive of VAT and any other charges under the WEEE directive.

7. Claims

Shortages, damages in transit or loss of goods must be advised in writing to the courier concerned and to Hilka Tools (UK) Ltd on day of receipt; along with qualified signatures that must be given to carriers.  Non deliveries of goods are to be advised in writing to Hilka Tools (UK) Ltd within 10 days of receipt of invoice.  Details given to our representative or sales office are helpful but not acceptable without written confirmation.

8. Guarantee

All items are guaranteed to be free from materials and workmanship defects for a period of 12 months from date of purchase unless stated otherwise. The guarantee does not cover normal wear and tear, nor damage caused by misuse, alteration, accident or repair. This guarantee is only available to the first user with proof of purchase.

9. Faulty Items

In the event of faulty items, these should be returned to our address with full documentation, or held for inspection by your area representative. Upon receipt, a credit note will be issued unless a replacement is requested.

10. Return of Goods

Hilka Tools (UK) Ltd does not deal on a Sale or Return basis. Goods will not be accepted for return without prior authorisation by the Area Sales Representative or the Sales Office Supervisor.  Items to be returned must be in a saleable condition, i.e. packed in inner and outer cartons as received, with full documentation enclosed.  Returns which do not comply with this requirement will not be accepted for credit. 

11.Exchange Surcharges

Prices are based on Exchange Rates at time of going to press and should there be any alteration to these rates we reserve the right to apply an Exchange Surcharge.

12. Amendments

Hilka Tools (UK) Ltd policy is to continually increase the content and quality of our tools and we reserve the right to alter the specifications or delete a product without prior notice.

13. Retention of Title

Notwithstanding delivery and the passing of risk, the property in and title to any goods shall remain with Hilka Tools (UK) Ltd, until Hilka Tools (UK) Ltd has received payment for the full price of:
(a) all goods,  products and or services subject to  the contract
(b) all other goods, products and or supplied by Hilka Tools (UK) Ltd to the buyer under any contract whatsoever
Payment of the full price shall include, without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between Hilka Tools (UK) Ltd and the buyer.

14. Overdue Accounts and Recovery

Hilka Tools (UK) Ltd may apply interest to all remaining outstanding balances following expiry of the credit terms stated above.  Such interest is to be calculated on a daily basis at a rate of 3% above the Bank of England Minimum Lending Rate. In the event of there being a necessity for the institution of legal proceedings for recovery of overdue or outstanding monies, then the full legal costs of recovery will be aggregated with the debt for which the proceedings will be instituted.

15. Credit Card Payments

For all payments by Credit Card, a charge of 2.5% will be added. Debit cards do not incur this charge.

16. Reproduction

Reproduction in whole or part of this catalogue is strictly prohibited without written permission.

17. Alteration and Amendments to these Terms

These terms and conditions cancel all previous terms and conditions. Hilka Tools (UK) Ltd reserves the right to change these terms and conditions. It is the seller’s responsibility to ensure they are using the most up to date terms and conditions which are available on our website or by request.

18. Governing Law

All terms and conditions shall be subject to and construed in accordance with English Law.

19. Warning

All Hilka Tools (UK) Ltd products are designed for a specific purpose. It is possible that some items could be used, or adapted for use as a weapon or other illegal purpose. Hilka Tools (UK) Ltd accepts no liability if our tools are used in an illegal or other improper use of any of the products. It is the re-sellers responsibility to ensure that products which are subject to age restriction are only sold to responsible persons over the appropriate legal age.

20. Cookies
